The Flag Code of India, 2002, effective from January 26, 2002, consolidated all laws, practices, and conventions regarding the National Flag, embodying the spirit of Article 51A(a) and reinforcing it as a symbol of our sovereignty.

1. Tripartite Structure of the Code

Part I (General Description): Mandates a rectangular shape with a length-to-height ratio of 3:2. The Ashoka Chakra must have 24 spokes, centrally placed.
Part II (Public & Private Display): Grants private citizens, educational institutions, and corporate bodies the right to hoist the flag on all days with dignity.
Part III (Official Display): Outlines specific protocols for display by Central/State governments, agencies, and VVIPs (e.g., President, Governors).

2. Salient Rules for Dignity and Honour

Prohibition of Misuse: The flag must not be used for commercial purposes, as drapery in any form, or as part of a costume.
Protocol of Hoisting: It must always be hoisted briskly and lowered slowly. It should never intentionally touch the ground or water.
Statutory Backing: Violations are punishable under the Prevention of Insults to National Honour Act, 1971.

3. Judicial Backing

In the Union of India vs. Naveen Jindal (2004) case, the Supreme Court declared that flying the National Flag freely with respect is a Fundamental Right under Article 19(1)(a) (freedom of speech and expression).

Material Relaxation (2021): The code was amended to allow machine-made and polyester flags, in addition to hand-spun/hand-woven Khadi, cotton, wool, and silk.
